In recent years the State of California has loosened regulations on ADUs in order to alleviate a shortage of affordable housing in major cities. Municipal governments, like the City of Los Angeles, responded by relaxing local ordinances and clarifying the rules for the creating and ongoing management of accessory dwelling units. While the laws change somewhat frequently (always be sure to check local government websites for the latest regulations), here are some general guidelines:

  • Owners must run their ADU plans by the city
  • A certificate of occupancy (COE) must be issued
  • Detached or attached ADUs are allowed
  • ADUs cannot be a recreation vehicle
  • ADUs cannot have wheels
  • Property owners are banned from leasing accessory dwelling units as short-term rentals (such as Airbnb)
  • Cities cannot require the creation of additional parking spaces if the property is within 0.5 miles of a major transit stop
  • Cities can adjust setback requirements and size restrictions on ADUs
